Happy Customer – Nurtured Earth Organics has a 100% satisfaction guarantee to you. If you are unhappy with a product we will exchange or refund the value of the item. We strive to provide a wonderful service and wholesome fresh food so your feedback is always welcome. To make a return, please inform us either by email or phone. ALL REFUNDS ARE ONLY APPLICABLE 36 HOURS AFTER DELIVERY

Allergen Statement – We pack a wide range of natural food products on shared equipment including nuts, seeds, grains and cereals. This includes sesame, peanuts, soy and gluten. While we do our best to avoid any kind of cross contamination this can occasionally occur and any of our products may contain traces of these. As distributors of products there is a possibility our suppliers could change the formulation at any time, without notice. We will take every care to communicate these changes to you. Customers concerned with food allergies need to be aware of this risk.

Minimum order value – All Nurtured Earth Organics Orders must have a minimum value of $50 excluding freight. If your order is less than $50 please contact us to see if we can process it. Nurtured Earth Organics do not deliver MILK ONLY orders. All milk orders must be accompanied by extra products to the value of at least $45.00 plus the value of the milk.

Ordering times – Orders requiring cow milk and La Tartine bread need to be placed by 2pm Friday. All other orders need to be placed by 4pm Sunday. Any orders placed after this time cannot be guaranteed Monday delivery. If you have difficulty placing the order by this time please contact us and we will try and assist you.

Delivery conditions – Delivery day is Monday. Orders under $100 incur a delivery fee of $5.50 unless other arrangements have been agreed. If you have difficulty placing the order by this time, please text, phone or email and we can assist you.

Delivery times and arrival of your order will be between 2.00- 6pm Monday. In the event of unforeseen circumstances, changes may be made to this delivery schedule. Nurtured Earth Organics accepts that in the event of goods arriving damaged due to our own transport, we will replace the goods as soon as possible (with delivery free of charge) or a credit will be issued for the damaged items.

Late Delivery – It is the customer’s responsibility to inform us if an order has not been delivered. We will follow up immediately to ensure delivery occurs as soon as possible.

Unattended deliveries – Nurtured Earth Organics cannot be held responsible for any unforeseen damage or theft to your order when left in a designated area specified by you. We recommend that your delivery is brought inside and stored away correctly as soon as possible.

Website – Nurtured Earth Organics has made every effort to ensure that the information on our website is correct at the time of publishing. We apologise if any errors have been made. All images used on this site are representations for your information only and are not necessarily true images of that specific product.

Nurturing Privacy Policy – Under no circumstances will we sell, rent or give your private information including name, address and email to third parties. We collect name and address information solely for the purpose of the delivery of goods.

Communications – We email registered customers weekly newsletters/recipes. We also send text message reminders for placing orders before cut off times. On each of these communications we provide a means by which the recipient may choose to unsubscribe.

Payment – Payment is to be made within 5 days of receipt of invoice, being the day which the goods were delivered. A statement stating the sum due and owing by the Customer to Nurtured Earth Organics at the date specified in the statement is prima facie evidence that the sum is due and owing at that date.

If the Customer makes default on any payment or otherwise fails to fulfill the terms of this or any other contract with Nurtured Earth Organics, or, if the Customer stops payment or calls a meeting of creditors or becomes insolvent or subject to bankruptcy laws, or as a company calls a meeting for the purpose of going into liquidation, or has a winding up petition presented against it, or has a receiver appointed to any of its assets, Nurtured Earth Organics reserves the right to suspend or cancel any existing contracts between Nurtured Earth Organics and the Customer or require payment in cash prior to the delivery of the goods notwithstanding the specified payment terms or may take over the goods and dispose of them without prejudice to any claim for damages from the Customer for any loss resulting from such resale or otherwise.

Interest on Overdue Payments – Interest charges at the rate of 2% per month will be charged on all overdue amounts and such interest is recoverable as a liquidated debt. A Late Payment Account keeping fee of $5 per month will be charged on any amount that is overdue on the Customers monthly statement. The Customer is liable for any expenses, including all legal expenses, incurred in connection with recovery of any overdue amounts and these expenses are recoverable as a liquidated debt.

Indirect Loss – In no event shall Nurtured Earth Organics be liable (whether before or after discharge of the contract or otherwise) for any loss or damage to the customer howsoever arising including any loss or damage arising from or caused or contributed to by negligence by Nurtured Earth Organics, its servants or agents, nor shall Nurtured Earth Organics be liable for special, incidental, indirect or consequential, or economic loss or damage suffered by the customer as a result of a breach by Nurtured Earth Organics of its obligations or otherwise including but not limited to economic or moral loss, loss of profits or revenue or costs arising from such breach.

Indemnity – The Customer shall indemnify and keep indemnified and hold Nurtured Earth Organics harmless from and against all liabilities, losses, damages, costs or expenses incurred or suffered by Nurtured Earth Organics, and from and against all actions, proceedings, claims or demands made against Nurtured Earth Organics, arising from one or more of the following:

a) As a result of the customer’s failure to comply with and laws, rules, standards or regulations applicable in relation to the goods or the use of the goods;
b) As a result of any other negligence, breach of contract or other breach of duty by the customer.
c) As a result of Nurtured Earth Organics adhering to instructions that the customer has given Nurtured Earth Organics about the goods.

TERMINATION – Nurtured Earth Organics may terminate or suspend this Agreement at any time by delivering notice advising you that your shopping privileges have been removed. Termination of this Agreement is effective the day the notice is received, or such later date as specified in the notice.
